ATTENDANCE: I will be voluntarily participating in the Retreat that will be conducted by the Organizer. The Retreat may include, but is not limited to, the "Retreat Activities".

PHOTOGRAPHY AND VIDEOGRAPHY: Any photos/video footage from the Retreat which includes my image and/or name, will be granted as use for our marketing and promotional purposes on a royalty-free basis. You authorize the Organizer to use and display any photographs, images, videotape or audio reproduction taken of you while engaged in activities sponsored by the Organizer, in any publication, multimedia production, display, advertisement and for any other legitimate purpose. The undersigned released and forever discharges the Organizer, as well, as its directors, trustees, officers, employees, agents and volunteers, owners, facilitators from any and all claims and demands arising out of or in connection with the use of said photographs, images, video and/or voice recordings

RETREAT FEES: The fee for the retreat is one payment of $1,151.00 or a deposit of $350 and 2 monthly payments of $400.50 for single-occupancy rooms. The fee for the retreat is one payment of $950.00 or a deposit of $350 and 2 monthly payments of $300.00 for double-occupancy rooms. If paying via a payment plan the payment will be drafted automatically from the method of payment within 30 day increments until the payment is paid in full.

REFUNDS: All fees associated with the Retreat are non-refundable. There are no exceptions.

CHARGE DISPUTES: You agree that you will not dispute the charge with your bank nor request funds.

This Retreat Waiver will bind and be enforceable against me and all of my personal representatives. I agree that this Retreat Waiver should be enforceable to the fullest extent of the law, and if any portion is held invalid, the remainder should continue in full legal force and effect.

I specifically acknowledge and agree that this document is not intended to be a general release, which would be limited under some state and local laws.

This Retreat Waiver shall be construed and interpreted as broadly as possible in the applicable jurisdiction.

ASSUMPTION OF RISK: I understand and am aware that my participation in the Retreat involves risks. These risks may lead to tangible or intangible harm, and I agree that they may result not only from my own actions but also from the actions of others. With the knowledge and understanding of these risks, I choose, of my own will and volition, to participate in the Retreat. I am also aware that there are risks that I may not have considered, yet I waive my right to any claims that may occur from these unconsidered risks and I choose, of my own will and volition, to participate in the Retreat. While every precaution shall be taken to ensure the good welfare and protection of participants, I assume all risks of participation in the Retreat activities. I recognize that there are inherent risks involved in outdoor, recreational and other activities. In consideration of the services provided during the Retreat, I, and on behalf of my executors, administrators, heirs, successors and assigns, hereby fully release and hold harmless, the Organizer and its directors, trustees, officers, employees, agents and volunteers, owners, facilitators for any and all liability for injuries, including those resulting in death, and/or illness incurred while participating in or attending any event during the Retreat.

MEDICAL TREATMENT AUTHORIZATION: I acknowledge that there is no obligation of any person to provide any participant with medical care during, prior to or after the Retreat. I further understand that, in the event that I require medical or dental treatment while engaged in activities with the Organizer during the course of the Retreat and am physically unable to express consent, reasonable efforts will be made to contact the emergency contact provided. However, if the emergency contact cannot be reached, I hereby consent and give permission to any directors, trustees, officers, employees, agents and volunteers, owners, facilitators acting on behalf of the Organizer as an agent for me, to consent to any diagnosis, treatment and hospital care advised and supervised by a physician, surgeon, or dentist licensed to practice under the law of the country/state where the services are rendered, either as an outpatient or in any hospital.

COVENANT NOT TO SUE: I will not start any lawsuit or other court action against the Organizer, nor will I join any such proceeding, including any claim for money damages. I acknowledge and agree that I am entering a covenant not to sue the Organizer in any capacity, including to hold the Organizer liable for any injury, loss, or damage sustained by me or my property, even if it is due to the Organizer's negligence or omission. I also waive the right of any of my insurers' to make any such claim.

INDEMNIFICATION: I agree to defend and indemnify the Organizer and any of its affiliates (if applicable) and hold them harmless against any and all legal claims and demands, including reasonable attorney's fees, which may arise from or relate to my participation in the Retreat or my conduct or actions. I agree that the Organizer shall be able to select its own legal counsel and may participate in its own defense, if desired.

REPRESENTATION: I am over 18 (eighteen) years of age, and am emotionally, medically, and physically able to participate in the Retreat.

GOVERNING LAW: This Retreat Waiver shall be governed by and construed in accordance with the internal laws of California without giving effect to any choice or conflict of law provision or rule. Each party irrevocably submits to the exclusive jurisdiction and venue of the federal and state courts located in the following county in any legal suit, action, or proceeding arising out of or based upon this Retreat Waiver: I have read the above Retreat Waiver fully and I understand and agree to its contents. I understand and agree that by signing this Retreat Waiver I forfeit any right, claim, or ability to hold the Organizer responsible for any tangible or intangible damages, loss of property, or loss of life that may occur during or after my use of the facilities and participation in the Retreat.

CONFIDENTIALITY: This relationship, as well as all information (documented or verbal) that the I shares with the Organizer as part of this relationship, will remain confidential. The Organizer agrees not to disclose any information pertaining to me without my written consent.

INTELLECTUAL PROPERTY: The Organizer retains all ownership rights to the materials provided during your participation in the Retreat. The copyrighted and original materials you are provided are for your individual use only and with a single-user license. You are not authorized to share, copy, distribute, or otherwise disseminate any materials received from me electronically or otherwise without my prior written consent. All intellectual property, including the copyrighted Retreat materials, shall remain the sole property of the Organizer, and no license to sell or distribute my materials is granted or implied. You agree not to reproduce, duplicate, copy, sell, trade, resell or exploit for any commercial or personal purposes, any portion of the Retreat, including any of the Retreat materials.

NON-DISCLOSURE: The Organizer shall not directly or indirectly disclose to any person other than a representative of Participant at any time either during the term of this agreement or following the termination or expiration thereof, any confidential or proprietary information pertaining to the Participant, including but not limited to customer lists, contacts, financial data.

GUARANTEES: There are no guarantees with outcomes for the Retreat. The Participant understands that the outcomes are impacted by Participants participation in the Retreat and several other factors, however, the Organizer cannot guarantee the outcome.

CANCELLATION: The Participant has the right to cancel their participation in the Retreat at any time. Upon cancelation, access to the Retreat, the Retreat Activities and Retreat Benefits will be revoked. However, cancellation does not extinguish the Participants responsibility to pay the full Retreat fee as outlined in section 3 above.

PERSONAL PROPERTY: I acknowledge and agree that I am responsible for all personal property during the Retreat and the Organizer is not responsible in any way for such property whether it is lost, stolen or damaged.




By signing this document, I, the Participant, confirm that I have authority to sign, and have read the entire document. I, hereby agree that by signing this document I consent to waive certain legal rights, including the right to sue the Organizer named above, and if applicable, its directors, trustees, officers, employees, agents and volunteers, owners, facilitators from any physical, material, tangible, or intangible, loss or damages that may happen during my participation in the Retreat.

I understand that refunds are not available. There are no exceptions.

By signing this contract, I agree that I will not dispute any charges with my bank nor request a refund.

I understand that if I select to pay via a payment plan the payment plan automatically drafts my account 30 days from initial payment until the Retreat is paid in full.

I understand if I do not pay the balance for this Retreat, legal action will be taken
for the remaining balance to be paid.
